Advocate General, Haryana *** VIKRAM AGGARWAL, J (ORAL) Prayer in the present petition preferred under Article 226 of the Constitution of India is for the grant of emergency parole for a period of two months on account of the petitioner suffering from coronary artery disease. 2. The petitioner was convicted under Section 302 IPC vide judgment of conviction dated 02.12.2023 passed by the Trial Court at Panipat. Vide order of sentence dated 05.12.2023, the petitioner was sentenced to undergo imprisonment for life and a fine of Rs.50,000/- was also imposed. 3. It is the case of the petitioner that he is suffering from coronary artery disease and has to undergo a bypass surgery. It has also been submitted that the functioning of his heart is 15% only and the petitioner wishes to get his surgery conducted in some specialized centre. 4. The medical status report has been filed in Court today, which is taken on record. It states as under:- “It is stated that convicted prisoner Ashok Kumar s/o Hansraj, 55 years Male presently lodged in District Prison, Karnal since 12.06.2025, FIR No.06/2001 under Sections 148 IPC, 323 IPC, 149 IPC, 324 IPC, 302 IPC, 25 Arms Act, Police Station Model Town Panipat (Panipat). Patient is K/C/O DM Type 2 & CAD. VIKAS CHANDER 2026.07.10 13.45 I attest to the accuracy and integrity of this document CRWP-7879-2026 -2- Patient Ashok Kumar son of Hansraj presented in Hospital OPD several times i.e. 16.06.2025, 23.06.2025, 25.06.2025, 30.06.2025, 14.07.2025, 29.08.2025, 31.10.2025, 03.01.2026 with complaints of K/C/O DM Type 2 & CAD for which Prison Medical Officer examined the patient and prescribed him medications. On dated 13.06.2026, patient name to hospital in emergency with complaint of chest pain for which Medical Officer examined the patient and referred to KCGMCH, Karnal in emergency department for which specialist doctor at KCGMCH, Karnal examined the patient and referred to higher centre PGIMS, Rohtak in Cardiology opinion on same day. On dated 14.06.2026 to 18.06.2026, patient remained admitted at PGIMS, Rohtak in Cardiology Department with diagnosis Type 2 DM/HTN/OLD IHD since 2007 onset CAD/USA/S.LVSD. After being discharged and patient’s referral is advised to higher Centre GB Pant Delhi/AIIMS Delhi for PET-CT Scan. On dated 22.06.2026, patient was referred to AIIMS New Delhi in Cardiology department for PET-CT Scan for which specialist doctors examined the patient and asked to come on 24.06.2026 for PET-CT Scan. On dated 24.06.2026, patient was referred to AIIMS New Delhi in Cardiology department for PET-CT Scan for which specialist doctors examined the patient and re-scheduled his appointment for PET-CT Scan on 30.06.2026 with charting of random blood sugar fasting and after breakfast. On dated 30.06.2026, patient was referred to AIIMS New Delhi in Cardiology department for PET-CT Scan for which specialist doctors examined the patient and his PET-CT Scan had been done on same day and he was asked to come on 03.07.2026 to collect his PET-CT report. On dated 03.07.2026 patient was referred to AIIMS New Delhi in Cardiology department to collect his PET-CT Scan report but doctors refused to give his PET-CT report as they asked him to bring CD of his coronary angiography which was conducted at PGIMS, Rohtak and prescribed him medication for 1 to 3 months. NOTE: The patient is suffering from severe coronary artery disease with total occlusion of LAD and LCX, hence markedly reduced LVEF of 15-20%. Considering the severity of his cardiac condition, he falls under a high risk category and requires specialised cardiac care, close monitoring and regular follow-up at a higher centre." 5. A perusal of the aforesaid report shows that the petitioner is suffering from severe coronary artery disease and has LVEF of 15-20% only. VIKAS CHANDER 2026.07.10 13.45 I attest to the accuracy and integrity of this document CRWP-7879-2026 -3- It has also been stated in the report that considering the severity of his cardiac condition, the petitioner falls under a high risk category and requires specialised cardiac care, close monitoring and regular follow-up at a higher centre. 6. Keeping in view the aforesaid medical status of the petitioner, the present petition is allowed. The petitioner is granted emergency parole for a period of two months starting from today. He be released in accordance with rules. He shall surrender back after expiry of the said period. A copy of the order be given under the attestation of the Special Secretary of the Bench.
