: This is a petition filed by the petitioner, whereby he is challenging the order dated 06.02.2026, passed by the learned trial Court. During the course of proceedings in a complaint case under Section 138 of Negotiable Instruments Act 1881, by virtue of above mentioned order, the petitioner was declared a proclaimed offender. It has been contended by learned counsel for the petitioner that subsequently on the basis of compromise the respondent- complainant has withdrawn the complaint, and therefore, by virtue of order dated 14.03.2026 the above mentioned complaint stands dismissed. It has been further contended that despite dismissal of above mentioned complaint, which amounts to acquittal of the petitioner, the police is harassing the petitioner. Since the order dated 14.03.2026, with regard to dismissal of complainant amounts to acquittal of the petitioner, merely because he was declared a proclaimed person during the course of above mentioned trial, the petitioner cannot be arrested. However, in my opinion, the proper remedy available to the petitioner is to approach the learned trial Court. CRM-M-36476-2026 (O&M) 2 trial Court may communicate to the police authorities that the petitioner is no longer required in the case, and therefore, need to be arrested. In view of above mentioned observations, learned counsel for the petitioner wants to withdraw this petition. Dismissed as withdrawn.
