1. This is the first bail application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, seeking grant of regular bail to the applicant, who is in judicial custody in connection with Crime No. 04/2026 registered at Police Station RUCHI YADAV Digitally signed by RUCHI YADAV
2 Konta, District Sukuma (Chhattisgarh), for the offence punishable under Section 20(b)(ii)(B) of the Narcotic Drugs and Psychotropic Substances Act, 1985.
2. As per the prosecution case, acting on the basis of secret information, the police intercepted the applicant and allegedly recovered 6.170 kg of ganja from his conscious possession. On the basis of the said recovery, the present crime was registered against the applicant for the offence punishable under Section 20(b)(ii)(B) of the Narcotic Drugs and Psychotropic Substances Act, 1985.

Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated in the present case. It is contended that the mandatory provisions of the Narcotic Drugs and Psychotropic Substances Act, 1985, have not been complied with, thereby vitiating the prosecution case. It is further submitted that the applicant has been in judicial custody since 11.02.2026, the investigation has been completed and the charge-sheet has already been filed. It is also submitted that the trial is likely to take considerable time to conclude. Accordingly, it is prayed that the applicant be enlarged on bail.
4. Per contra, learned State counsel opposes the bail application and submits that the applicant has one criminal antecedent under the Narcotic Drugs and Psychotropic Substances Act, 1985. Accordingly, it is prayed that the bail application be dismissed.

5. I have heard learned counsel for the parties and perused the material available on record.

Considering the overall facts and circumstances of the case, the nature and gravity of the allegations, the alleged recovery of 6.170 kg of ganja from the conscious possession of the applicant and the criminal antecedent of the applicant under the Narcotic Drugs and Psychotropic Substances Act, 1985, this Court is not inclined to grant bail to the applicant at this stage. Accordingly, the bail application preferred by the applicant, Ajit Arumugam, in connection with Crime No. 04/2026 registered at Police Station Konta, District Sukuma (Chhattisgarh), for the offence punishable under Section 20(b)(ii)(B) of the Narcotic Drugs and Psychotropic Substances Act, 1985, deserves to be and is hereby rejected at this stage.
7. Needless to say that the trial Court concerned is at liberty to proceed and conclude the trial expeditiously.
8. The Office is directed to provide a certified copy of this order to the trial Court for necessary information and compliance forthwith. Sd/-
