01. 1. Heard learned counsel for the Petitioners and
learned counsel for the State.
2. The Petitioners are seeking pre-arrest bail in connection with G.R. Case No.319 of 2026 pending on the file of learned J.M.F.C., Tirtol, arising out of Tirtol P.S. Case No.281 of 2026 for commission of offences punishable under Section 329(2)/ 126(2)/ 296/ 115(2)/ 74/ 324(2)/ 303(2)/ 351(2)/ 3(5) of BNS.
3. At the outset, learned counsel for the State, on instruction, submits that in the meanwhile the p. 2 Investigating Agency has resorted to the provisions contained in Section 35(3) of the BNSS in respect of Petitioner Nos.2 and 3.
4. In view of the same, since there is no perceptible threat of arrest, the ABLAPL accordingly stands disposed of in respect of Petitioner Nos.2 and 3.
5. Thus, the ABLAPL is confined to Petitioner Nos.1, 4, 5 and 6.
6. It is submitted by the learned counsel for the Petitioners that to wriggle out of the counter FIR, which is on record at Annexure-6, the Petitioners have been falsely entangled in the case at hand.
7. And, it is further submitted that matrimonial dispute and other connected cases arising out of such matrimonial disputes are pending between Petitioner No.3 and the son of the informant and to feed fat their grudge, the Petitioners have been falsely implicated.
8.
Learned counsel for the State opposes the prayer for pre-arrest bail.
9. Taking into account the nature of allegation and the litigation inter se between the parties, this Court directs that on surrendering within three weeks hence and moving for bail, the Petitioner Nos.1, 4, 5 and 6 shall be released on bail by the p. 3 learned Court in seisin on such terms as deemed just and proper.
10. It is needless to state that the Petitioner Nos.1, 4, 5 and 6 shall cooperate with the ongoing investigation.
