Accused no.4 in Crime No.101/2022 registered by Bellanduru Police Station, Bengaluru City, for the offences punishable under Sections 364A, 343, 323, 504, 506 read with 149 of IPC, is before this Court under Section 483 of BNSS, 2023, seeking regular bail. 2. Heard the learned Counsel for the parties. 3. FIR in Crime No.101/2022 was registered by Bellanduru Police Station, Bengaluru City, for the offences punishable under Sections 364A, 343 of IPC against Nishanth and others based on the first information dated 07.05.2022 submitted by Rathnamma - wife of alleged victim Alexandar. In the said case, petitioner was arrayed as accused no.4 in the FIR. During the course of investigation, some of the accused were arrested and after completing investigation, charge sheet was filed against five persons for the aforesaid offences. Petitioner was shown as absconding in the said charge sheet. Therefore, a split-up case was registered against him and in the said case, he was arrested and remanded to judicial custody on 02.06.2026. His bail application filed before the jurisdictional - 3 - HC-KAR NC: 2026:KHC:35922 CRL.P No. 8512 of 2026 Sessions Court in Crl. Misc. No.5418/2026 was dismissed on 10.06.2026. Therefore, he is before this Court. 4. Perusal of the material on record would go to show that there was a dispute between the alleged victim and accused no.1 - Nishanth with regard to certain monetary transactions. After the charge sheet was filed in the present case, accused nos.1 to 3 had approached this Court in Crl.P.No.6578/2024 with a prayer to quash further proceedings in the case as against them on the ground that monetary dispute between the victim and accused no.1 had settled. Based on the joint affidavit filed by the parties, the proceedings as against accused nos.1 to 3 has been quashed by the coordinate bench of this Court in Crl.P.No.6578/2024 disposed of on 26.07.2024. 5. It appears that after the petitioner was arrested, even he has filed a petition under Section 528 of BNSS, 2023, in Crl.P.No.8549/2026 with a prayer to quash the further proceedings in the present case as against him and in the said petition, the coordinate bench of this Court has stayed the further proceedings in the present case as against him. Under the circumstances, I am of the opinion that petitioner's prayer - 4 - HC-KAR NC: 2026:KHC:35922 CRL.P No. 8512 of 2026 for grant of regular bail is required to be answered affirmatively. Accordingly, the following order: 6. The petition is allowed. The petitioner is directed to be enlarged on bail in Crime No.101/2022 registered by Bellanduru Police Station, Bengaluru City, for the offences punishable under Sections 364A, 343, 323, 504, 506 read with 149 of IPC, subject to the following conditions: a) Petitioner shall execute personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future; - 5 - HC-KAR NC: 2026:KHC:35922 CRL.P No. 8512 of 2026 e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off.
