Case No.177 of 2025 dated 04.09.2025 under Sections 21(c)/22(c)/23(c)/27A/28 of the NDPS Act. And In the matter of: Bablu Barman … petitioner Mr. Anindya Ghosh Ms. Sumita Sarkar … for the petitioner Mr. Rajendra Banerjee Mr. Shataroop Purkayastha … for the State Learned advocate appearing for the petitioner submits that the petitioner is in custody for 293 days and the petitioner has been implicated on the basis of the statement of the co-accused. There has been alleged recovery of 196 gms of methamphetamine. Charge sheet has been submitted before the jurisdictional court. As such, the petitioner prays for bail. Learned advocate appearing for the State opposes the prayer for bail and submits that from three persons huge quantum of methamphetamine has been seized. The case records only refer to the statements of witnesses and there has been no recovery from the present petitioner. Having considered the same, I am inclined to release the petitioner on bail. As such, the prayer for bail of the present 2 petitioner is allowed. The petitioner, namely, Bablu Barman shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties of Rs.10,000/- each, one of whom must be local to the satisfaction of the learned Judge, under NDPS Act, 3rd Court, Balurghat, Dakshin Dinajpur. If on bail, the petitioner shall be physically present on each and every date before the learned trial court and shall not leave the district of Dakshin Dinajpur without prior permission of the learned special court. Thus, CRM(NDPS) 1064 of 2026 is allowed. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
