Learned counsel for the petitioner submits that the petitioner was appointed as Attendant Grade-III Lineman in the year 2011 in the respondent/CSPDCL Department. The petitioner filed an application dated 05.02.2020 (Annexure-P/2) before the respondent Department seeking permission for higher studies (LL.B.), but thereafter, he allegedly did not report for duty. He further submits that the said application seeking permission was rejected by the respondent, and the same was communicated to the petitioner vide order dated 14.09.2022 (Annexure-P/4). He also submits that the respondents issued notices to the petitioner time and again stating that since he has not been present on duty since 29.11.2021, his salary has been stopped with effect from January 2022. He further submits that since the petitioner had already filed an application seeking permission for higher studies, the rejection of the application and the stoppage of salary are not sustainable. 3. None appears for the respondents. However, the respondents have filed their return stating therein that this petition has become infructuous, as the relief claimed by the petitioner regarding the quashing of the notice stands merged into the charge-sheet, which is under challenge in the subsequent writ petition bearing WPS No.6085/2023. It is further stated that on 06.07.2023, the petitioner was served with a charge-sheet regarding unauthorized absence since 23.11.2021. The said charge-sheet is yet to be decided, and the 3 prayer for the release of salary for the aforesaid period is subject to the decision in the departmental proceedings. As such, a prayer has been made to dismiss the present writ petition. 4. Heard learned counsel for the petitioner and perused the reply filed by the respondents. 5. WPS No. 6085/2023 (Narendra Kumar Verma Vs. State of C.G. and others) filed by the petitioner is also listed along with the present case for hearing, in which the petitioner has challenged the notices and the stoppage of his salary which are also claimed in the present writ petition. Under such circumstances, considering the reply of the respondents, since a charge-sheet has already been issued to the petitioner for alleged unauthorized absence which has been challenged in WPS No. 6085/2023 and considering that the issue involved in this writ petition is already the subject matter of the aforesaid subsequent writ petition, this writ petition has become infructuous. 6. Consequently, the present writ petition is disposed of as having become infructuous. 7. Pending application(s), if any, stand disposed of. 8.
