....Petitioner
Versus The State of Jharkhand
....Opp. Party
---------
CORAM: HON’BLE MR. JUSTICE DEEPAK ROSHAN
--------- For the Petitioner : Mr. Ritesh Kumar, Advocate For the Opp. Party : Mr. Naveen Kr. Ganjhu, A.P.P.
--------- 03/ 01.04.2026 Heard learned counsel for the parties.
2. The instant bail application has been preferred by the petitioner for grant of regular bail in connection with Gumla P.S. Case No. 371 of 2025 for the offences registered under Sections 103(1)/3(5) of Bharatiya Nyaya Sanhita, 2023, pending in the court of learned Chief Judicial Magistrate, Gumla.
3.
Learned counsel for the petitioner submits that petitioner is innocent and has not committed any offence. Learned counsel further submits petitioner is not named in the FIR and his name transpired on the basis of his confessional statement before the Police, which has got no evidentiary value in the eyes of law. Learned counsel further submits that there was a land dispute between the parties and just to settle the said dispute, the present FIR has been lodged against the co- accused persons and subsequently, the name of this petitioner has falsely been inserted during course of investigation. Petitioner has got no criminal antecedent. He further submits that petitioner is languishing in custody since 14.11.2025; as such, the petitioner may be enlarged on bail. Learned counsel further submits that the petitioner is ready to abide by every condition imposed by this court.
4. Learned A.P.P. for the State opposes the prayer for bail of the petitioner and submits that the allegation against the petitioner is serious in nature inasmuch as the petitioner along with other co- accused had committed murder of a 7 years old boy. The sister of the

5. Looking to the gravity of charge against the petitioner coupled with the material facts available in the case diary, I am not inclined to enlarge him on bail at this stage.
6. Accordingly, the instant application stands dismissed.
