This is the first bail application filed under Section 483 of the BNSS, 2023 for grant of regular bail to the applicant who has been arrested in connection with Crime No.330/2025, registered at Police Station- Civil Lines Rampur, Korba, District- Korba (CG) for the offence punishable under Sections 137(2), 64(m), 87, 296, VASANT KUMAR Digitally signed by VASANT KUMAR Date: 2026.07.22 17:02:51 +0530
2 115(2), 351(3), 64(1)/49, 3(5) of BNS and Sections 4, 6 of POCSO Act. 2. The prosecution case, in brief, is that the prosecutrix went missing from her house on 03.06.2025, whereupon her mother lodged a missing report on 04.06.2025. During investigation, the prosecutrix was recovered on 30.12.2025, and based on her statement, the present applicant and other co-accused were arrested. The allegation against the applicant is that he facilitated the prosecutrix's journey by dropping her from Korba to Delhi, following which offences under the BNS and the POCSO Act were registered against him and the co-accused. 3. Learned counsel for the applicant contended that the applicant has not committed any offence and has been falsely implicated in the said case. He further contended that as per prosecution case, the applicant has not committed rape or sexual assault with the victim and he further contended that there was affair between the co- accused Raju Mishra and the prosecutrix and the applicant has only dropped the prosecutrix and the applicant is in jail since 18.01.2026, and the trial will take considerable time for its conclusion, therefore, the applicant may be released on bail. 4.
Learned State counsel opposes the submission made by learned counsel for the applicant and would submit that as per statement
3 of the victim, the present applicant was taken the victim from Piparpara Kohadiya to Bilaspur and thereafter the applicant was taken the victim to Charbag Delhi where after staying 3-4 days, applicant left the victim with co-accused Raju Mishra, therefore, the applicant may not be released on bail. 5. Pursuant to order dated 29.06.2026, victim and her mother appeared before this Court through virtual mode from the DLSA- Korba (C.G.). On being asked, they raised objection for grant of bail to the applicant. Their statements are taken on record. 6. I have heard learned counsel for the parties. 7. Considering the facts and circumstances of the case and further considering the material available on record, this Court is not inclined to grant bail to the applicant. 8. Accordingly, the bail application of the applicant stands rejected. 9. Office is directed to send a certified copy of this order to the trial Court concerned for information.
