[ Mr. Soumen Datta Mr. Pinki Brata Ghosh …for the petitioner This application under Article 227 of the Constitution of India is at the instance of the plaintiff praying for direction upon the learned Civil Judge (Senior Division), Chandernagore, Hooghly, to dispose of the Title Suit no. 800 of 2017 expeditiously. The learned Advocate appearing for the petitioner submits that several interlocutory applications one under Order 39 Rule 1 & 2 of the Code of Civil Procedure filed by the petitioner, application under Order 39 Rule 4 of the Code of Civil Procedure filed by the opposite party, an application under Order 39 Rule 7 of the Code of Civil Procedure are pending. In view of the order sought and proposed to be passed, there is no necessity to serve notice upon the opposite party. However the learned Advocate-on-Record for the petitioner shall be obliged to forward a copy of this application along with a server copy of this order to the opposite party forthwith. In the light of the submission made by the learned Advocate for the petitioner, this civil revisional application stands disposed of by requesting the learned Civil Judge (Senior Division), Chandernagore, Hooghly, to take up the hearing of the application under Order 39 Rule 7 of the Code of Civil Procedure on the next date fixed i.e. on 18th July, 2026, if the same is otherwise ready for hearing and shall make all endeavour to dispose of the same as expeditiously as possible, without granting any unnecessary adjournments to either of the parties. The learned Trial Judge is further requested to make all endeavour to dispose of the other pending interlocutory applications expeditiously without grating any unnecessary adjournments to either of the parties.
