Order No.02
Date: 05.10.2026
Heard the learned counsel for the respective parties.
This appeal is directed against the order dated 12.08.2026 passed by the learned Sessions Judge, Gumla in B.P. No. 441 of 2026 arising out of Bishunpur P.S. Case No. 33 of 2025, whereby and whereunder, the prayer for bail of the appellant has been rejected.
It has been alleged that there was an exchange of firing between the police personnel and the extremists as a result of which, three of the extremists had died.
Submission has been advanced by the learned counsel for the appellant that only on the basis of suspicion, the appellant has been named in the first information report. It has been submitted that though the appellant has criminal antecedents but in all cases, he is on bail. It has further been submitted that the appellant is in custody since 21.05.2026.
Learned counsel for the State has opposed the prayer for bail of the appellant.
On perusal of the first information report, it does appear that the appellant has been implicated only on the basis of suspicion and even there is nothing in the first information report to suggest that the appellant was identified by the extremist.
