Mrs. Amrita Kumar, learned APP has submitted that the appellant-Shankar Munda has died on 15.07.2020 and photo copy of Death Certificate of the appellant-Shankar Munda has been enclosed as Annexure-A in the counter affidavit. 3. From perusal of Death Certificate (Annexure-A) dated 04.08.2020 issued by the Department of Planning and Development (Directorate of Statistics and Evaluation), it appears that the Appellant namely, Shankar Munda has died on 15.07.2020. 4. Under the circumstances, this Criminal Appeal stands abated on account of death of the Appellant-Shankar Munda under section 394 of Cr.P.C. 5. Thus, Cr. Appeal (S.J) No.308 of 2019 stands abated against the sole Appellant- Shankar Munda. 6. Let the original Lower Court Record be sent to the learned Court below with the copy of this order.
