01. 1. Heard learned counsel for the Petitioners and
learned counsel for the State.
2. The Petitioners are seeking pre-arrest bail in connection with G.R. Case No.1077 of 2026 pending on the file of learned S.D.J.M., Jagatsinghpur, arising out of Balikuda P.S. Case No.240 of 2026 for commission of offences punishable under Sections 115(2)/126(2)/3(5)/351(2)/74 of the BNS, 2023.

It is submitted by the learned counsel for the Petitioners that the allegation is on account of scuffle relating to taking drinking water from the pipeline and the accusations made has to be understood in the context of the same. It is said that the Petitioners have no antecedent. Hence, he may be protected by pre-arrest bail.

Learned counsel for the State opposes the prayer for pre-arrest bail.

Taking into account the submissions as above and the role ascribed and the background under which the offence has been committed, it is directed that on surrendering within three weeks hence and moving for bail, Petitioners shall be released on bail by the learned Court in seisin on such terms as deemed just and proper subject to verification of antecedents. If it comes to fore that the Petitioners have any criminal antecedent, this order shall not be given effect to.
6. It is needless to state that the Petitioners shall cooperate with the ongoing investigation.
7. The ABLAPL is accordingly disposed of.
