DATED : 27-07-2026 By this application, the applicant/appellant is seeking condonation of delay of 28 days, which is caused in preferring the appeal. 2. As per the contention of the applicant, he was behind the bar from 02-02-2024 till the date of judgment i.e. 20-04-2026. After pronouncement of the judgment, he was shifted to Central Prison, Nagpur as a convicted prisoner. It is further contended by him that his sister was not keeping well since long and except her there was no one to look after regarding preferring of the appeal. Therefore, he could not file the appeal within time. 3. Learned Additional Public Prosecutor strongly opposed the said contention and submitted that in absence of the reasonable and sufficient cause, the application deserves to be rejected. 4. On hearing both the sides and on perusal of the record, it reveals that the applicant is languished in Jail and there was nobody to look after regarding preferring of the appeal as his sister was not found well since 2 appa 537.26 long, which appears to be just and proper one. Moreover, the statutory right to file appeal is also involved. In view of that, the application deserves to be allowed. Accordingly, we proceed to pass the following order. Application is allowed. Delay of 28 days in preferring the appeal is condoned. Appeal be registered. Criminal Appeal (Stamp) No. 7720/2026 On registration of the appeal, learned Additional Public Prosecutor waives service of notice for the respondents/State. 2. Admit. 3.
