The petitioner who is the mother of detenu-Kiran Kumar CTP No.16029 is before this Court seeking for the following reliefs: a. Issue writ, direction or order in the nature of Writ of Certiorari and quash the endorsement bearing No.CPB/CTP-Sec/1082/2026 dated 27.05.2026 issued by Respondent No.2 at Annexure A and release petitioner's son Kiran Kumar (Convicted prisoner No.16029) on parole for a period of 90 days. b. Any other order that this honorable court deems fit in the interests of justice, equity and good conscience. 2. The detenu had been convicted in S.C.No.174/2023 for offences under Section 302, 506 of IPC by the Prl. District and Sessions Judge, Kolar and sentenced on 16.03.2026 with the highest of the sentence being imprisonment for life. The detenu has served a period of 2 years 11 months 5 days of imprisonment as on 01.06.2026 and his conduct in jail is said to be satisfactory. The petitioner having made an - 3 - HC-KAR NC: 2026:KHC:33950 WP No. 17461 of 2026 application for parole, the same came to be rejected on account of adverse report having received by the police. 3. A perusal of the police report indicates that it deals with the conviction of the detenu and does not cover any issue as regards the petitioner is at flight risk and or could cause any harm or injury to the victim/s or victim/s causing any harm to the detenu. 4. The application has been filed by the mother of the detenu seeking his release on parole for the purpose of fencing the agricultural land owned by the family. As on 01.06.2026, the detenu has undergone incarceration for a period of 2 years, 11 months and 5 days. Having regard to the nature of the offences alleged against the detenu under Sections 302 and 506 of the IPC, and considering the period of incarceration undergone thus far, the application cannot be considered at this stage.
