Learned advocate appearing for the appellant submits that the appellant is in custody for 10 months and the evidence of the victim is over. It has also been pointed out that there has been change of version of the victim from initial statement which was divulged before the investigating officer of the case and also before the learned Judicial Magistrate. Learned advocate for the CBI opposes the prayer for bail and submits that 6 witnesses have been examined and 12 more witnesses are yet to be examined. Learned advocate for the State also opposes the prayer for bail. I have taken into account the overall circumstances and 2 the degree of participation of the present petitioner. Having considered the complicity of the present petitioner, I am inclined to release the appellant on bail. The appellant, namely, Rahim Sk @ Khokan @ Natka shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties of Rs.10,000/- each, one of whom must be local to the satisfaction of the learned CJM, Purba Bardhaman. If on bail, the appellant shall stay within the jurisdiction of Calcutta and North 24 Parganas and meet with the investigating officer of the case or any officer assigned by the Superintendent of Police, CBI Special Crime Branch till the trial is over. Additionally, the appellant shall be physically present on each and every date before the learned trial court and shall not create circumstances which will deter the trial court from proceeding with the present case. Accordingly, CRA(SB)107 of 2026 is allowed. Status report submitted by the State be kept with the record. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
