JUSTICE SURAJ GOVINDARAJ ORAL ORDER 1. The petitioner who is the sister of detenu-Raju C (CTP No.13604) is before this Court seeking for the following reliefs: a. Direct the Respondent No.2 to release the Petitioner's Brother convict namely Raju C S/o Chandrappa (CTP -13604) on general parole for the period of 90 days in the interest of justice which has been rejected at Annexure-B dtd. 22.04/05.2026. b. Pass any other order(s) which this court may deem fit and proper under the facts and circumstances of the case, in the interest of justice. 2. The detenu had been convicted in Spl.C.No.845/2021 for offences under Section 363, 302 of IPC and Section 4 & 6 of POCSO Act, by the FTSC-1, ACC & SJ, Bengaluru and sentenced on 25.05.2023 with the highest of the sentence being imprisonment for life. The detenu has served a period of 5 years 1 months 18 days of imprisonment as on 02.06.2026 and his conduct in jail is said to be satisfactory. The petitioner having made an application for parole, the - 3 - HC-KAR NC: 2026:KHC:33952 WP No. 17363 of 2026 same came to be rejected on account of adverse report having received by the police. 3. The application has been filed by the sister of the detenu seeking his release for the renovation of the house. The detenu has been convicted and sentenced to imprisonment for life for offences punishable under Sections 363 and 302 of the IPC and Sections 4 and 6 of the POCSO Act. He has undergone incarceration only for a period of 5 years 1 month and 18 days. In my considered opinion, the renovation of the house would not be a good enough reason to release the detenu.
