ORAL ORDER
The petitioners are before this Court, seeking the following prayer:
"WHEREFORE the petitioners pray that this Hon'ble court kindly be pleased to quash the FIR and Chargesheet filed/registered in Crime No. 96 of 2020, C.C.No.16221/2021 by East Zone Women PS Police Station, Bengaluru with regarding to the offence punishable under section 498A, 323, 504 of Indian Penal Code and under section 3 & 4 of Dowry Prohibition Act 1961 which is pending on the file of the XIth Addl. Chief Judicial Magistrate At Bengaluru in the interest of justice."
2. Heard Sri. Narayanaswamy M., learned counsel appearing for the petitioners, Smt. Waheeda M.M., learned HCGP appearing for respondent No.1 and have perused the material on record.

Learned counsel appearing for the petitioners taking this Court through the documents appended to the petition

would demonstrate that the complainant herself has sought to withdraw the subject petition before the mediation. The memorandum of settlement filed under Section 89 of CPC read with Rules 24 and 25 of the Karnataka Civil Procedure (Mediation) Rules, 2005, reads as follows:
"MEMORANDUM OF SETTLEMENT UNDER SECTION 89 OF CPC READ WITH RULES 24 AND 25 OF THE KARNATAKA CIVIL PROCEDURE (MEDIATION) RULES, 2005. I. The petitioner has filed MC No.6233/2021 petition under section 13 (1) (i-a) (i-b) of Hindu Marriage Act, 1955 seeking dissolution of marriage between the parties. II. During the pendency of the above case, the parties were referred to mediation process of this Hon'ble court for resolving the dispute between the parties. During mediation, at the intervention of mediator, the parties themselves, and their respective advocates upon discussions and negotiations have resolved their disputes amicably and mutually have agreed to the following terms and conditions:
1. The parties are Hindus by religion, and they state that their marriage was solemnized on 12.09.2019 at Samruddhi Convention Centre, Katamnallur Gate, White Field Road, Bengaluru - 560049 as per Hindu rites and customs. III. The parties state and admit that due to irreconcilable differences and incompatibility of temperaments, they are separated since June 2020. The efforts made by the elders, friends and well wishers to resolve the differences between the parties did not yield any fruits. The petitioner and the respondent know that their marriage is irretrievably broken down and there are no chances of reunion to lead a happy married life. Hence, the petitioner and the respondent have decided to get the marriage dissolved by a decree of divorce. - 5 -

2. Both the parties state that they have no children born from this wedlock. 3. Both the parties have agreed that they are financially independent, hence they are not claiming any permanent alimony/maintenance against each other. 4. Both the parties have already exchanged their articles and valuable belongings with each other. 5. The parties also hereby state and agree that they do not have any claims over the moveable or immoveable assets belonging to each other and their family members, either existing or to be acquired in future. 6.
Both the parties hereby declare that they shall have no claim of any nature whatsoever against each other present past or in future. 7. Both the parties without referring to the allegations mentioned in the petition either orally or expressly have arrived at the settlement on their own will and wish. 8. Both the parties herein state that there is no undue influence, force, or coercion in entering into this agreement from any one or any thing. 9. Both the parties admit that they shall not interfere in each other's lives for any reason of whatsoever from this day. 10. In view of the settlement arrived at in this case the petitioner has agreed to withdraw Crl.Misc.No.19/2022 filed under DV Act., pending on the file of MMTC-I., Bengaluru. 11. The petitioner has also agreed to co-operate with the respondent for closure/quash of CC.No.16221/2021 filed under section 498A of IPC., section 3 & 4 of DP act pending on the file of ACMM-VI., Bengaluru. 12. The respondent has filed MC.5599/2021 which is pending on the file of 2nd Addl. Family Court, Bengaluru. He has agreed to withdraw the same. - 6 -

IV. In view of the aforesaid agreement entered into between the parties, the parties pray that this Court be pleased to dissolve the marriage solemnized on 12.09.2019 at Samruddhi Convention Centre, Katamnallur Gate, White Filed Road, Bengaluru - 560049 by granting a decree of divorce in terms of the agreement. V. Parties will appear on 08.04.2024 before the Hon'ble court for passing orders in terms of the agreement."
4. Therefore, in light of the settlement arrived at between the parties quoted supra, I deem it appropriate to terminate the proceedings pending against these petitioners in the subject petition. 5. For the aforesaid reasons, the following:
ORDER i. Criminal Petition is disposed. ii. Proceedings in C.C.No.16221/2021 pending before the XI Additional Chief Judicial Magistrate, Bengaluru, stands quashed, qua the petitioners.
