Borbhuiya, learned counsel for the petitioner. Also heard Mr. A.K. Ghosh, learned Standing Counsel, Panchayat and Rural Development Department and Ms. M. Bhattacharjee, learned Additional Senior Government Advocate, appearing for the respondent No.3. 2. The petitioner is aggrieved that for the period which he has served as a President of 14 No. Bichennala Gaon Panchayat under the Rangia Anchalik Panchayat in the district of Kamrup, his salary w.e.f. August, 2019 to December, 2020 has not been paid @ Rs.5000/- per month. In spite of representation filed, the salary has not been released. 3. The writ petition was filed in the year 2023. Notice in the matter was issued on 14.06.2023. No instructions are forthcoming from the Panchayat and Rural Development Department, nor has any affidavit been filed. 4. Under such circumstances, this Court is of the considered view that the writ petition be disposed of with a specific direction to the Commissioner and Secretary to the Government of Assam, Panchayat and Rural Development Department to examine the case of the writ petitioner towards his claim for payment of his salary as a President of 14 No. Bichennala Gaon Panchayat, which he claims from August, 2019 to December, 2020 and which according to the petitioner has not been released. The authority concerned will examine the matter and pass an appropriate speaking order and a copy or the speaking order be served on the petitioner. If the claims of the petitioner Page No.# 3/3 are found to be acceptable, then the salary be released by the respondent authority as expeditiously as possible within a outer limit of eight weeks from the date of order is passed by the Commissioner and Secretary to the Government of Assam, Panchayat and Rural Development Department. 5. The said Commissioner and Secretary to the Government of Assam, Panchayat and Rural Development Department will pass an effective order as directed within four weeks from the date of receipt of a certified copy of this order. 6. The writ petition is disposed of in terms of the above. JUDGE Comparing Assistant
