O R D E R [1] Heard Mr. N. Suresh Meetei, learned counsel appearing for the petitioner and Mr. Shyam Sharma, learned GA appearing for the respondents. [2] As agreed to by both the counsel appearing for the parties, the present writ petition is being disposed of at the Motion stage itself. [3] At the outset, it has been submitted by the learned counsel appearing for the petitioner that the Secretariat: Land Resources Department, Government of Manipur, has initiated certain actions with regard to the proposed acquisition of land in Makhuam Marangjing, Haochong Sub-Division, Noney District, measuring an area of about 144.91 acres as required by the NF Railway as clearly reflected in the Notification dated 05-03-2025 issued by the Secretariat: Land Resources Department, Government of Manipur (Annexure – A/14 of the writ petition).
[4] The learned counsel appearing for the petitioner submitted that the present writ petition may be disposed of by issuing a simple direction to the respondents that in the event the authorities required to acquire the land mentioned hereinabove for utilization of public purpose, the respondents shall strictly adhere to the provisions as provided under the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 and Rules made thereunder. -2-

[5] Mr. Shyam Sharma, learned GA appearing for the respondents fairly submitted that if the authorities are at all required to acquire the said land in question, they are duty bound to strictly follow the provisions of law as provided under the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 and Rules made thereunder. The learned GA, accordingly, submitted that he has no objection in disposing of this writ petition as prayed for by the learned counsel appearing for the petitioner. [6] In view of the submission made by the learned counsel appearing for the parties, this court is of the considered view that it will be in the interest of justice to dispose of this writ petition by directing the respondents that in the event the respondents required to acquire the aforementioned land for utilization of public purpose, the authorities should strictly adhere to the provisions as provided under the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 and Rules made thereunder. Ordered accordingly. With the aforesaid direction, the present writ petition as well as the connected application are hereby disposed of. JUDGE Devananda
