Petitioner is before this Court seeking for the following reliefs: "A. Issue a writ in the nature of mandamus directing the respondents permit the Petitioner to run the business of the distributorship of the products of Ceragem India Pvt Limited at the premises bearing No.94/1, First Floor, M.M. Road, Frazer Town, Bangalore - 560 005, without any interference, except following the due process of law and; B. Issue a writ in the nature of mandamus directing the 2nd Respondent to release and hand over the keys of the premises bearing No.94/1, First Floor, M.M. The grievance initially of the petitioner was that the seizure of the goods of the petitioner and the locking of the premise of the petitioner was made by the police on their own without an FIR having been registered. 3. It is in that background that respondents were called upon to obtain instructions as to on what basis such seizure and sealing of the premises has been effected. 4. Today, the learned Additional Government Advocate has filed a memo along with certain documents including an FIR in Crime No.60/2026 registered under Section 318(3) of the Bharatiya Nyaya Sanhita, 2023. - 4 - HC-KAR NC: 2026:KHC:35448 WP No. 20799 of 2026 5. Her submission is that the seizure has been made in terms of the warrant issued by the I ACJM, Bengaluru in PS Crime No.60/2026 and pursuant to the seizure, a PF memo has been drawn up and the said seized articles are now in the Custodia legis i.e. before the I ACJM, Bengaluru. If that be so, it would be for the petitioner to approach the said Court seeking for release of the said material which have been seized. There being a complaint in Crime No.60/2026 which has already been registered, it is always available for the petitioner to take such appropriate remedies available under law and make such application as a necessary before the I ACJM. 6.
