Heard Mr.Ankush Soni, learned counsel for the petitioner as well as Mr.Sumit Singh, learned Deputy Advocate General appearing for respondents No.1 to 3./State. 2. The present writ petition has been filed by the petitioner with the following prayers: “i. This Hon'ble Court may kindly be pleased to issue a writ, order, or direction commanding Respondent No. 3 to immediately register a regular First Information Report (FIR) against Respondent Nos. 4 and 5 based on the complaints dated 04/04/2026 and 15/01/2026 under the appropriate provisions of the Bharatiya Nyaya Sanhita, 2023 and the Information Technology Act, 2000. ii. This Hon'ble Court may kindly be pleased to direct a specialized, time-bound investigation to be supervised by Respondent No. 2, specifically mandating a forensic cyber audit of the email addresses, digital consent submissions, and IP logs used to upload the fraudulent manuscript to the International Journal of Advanced Biochemistry Research. iii. This Hon'ble Court may kindly be pleased to issue a protective order directing the university administration and private respondents to refrain from taking any adverse, punitive, or retaliatory academic steps against the Petitioner during the pendency of the criminal investigation. iv. This Hon'ble Court may kindly be pleased to allow 3 any other relief which the Court deems fit and proper with the cost of the petition.” 3. Learned counsel for the petitioner would submit that despite several complaints, the respondent authorities have not taken any action on the complaints made by the petitioner. 4. Learned State counsel, on the other hand, has submitted that the grievance of the petitioner can be very well redressed before the Court below by filing an application under Sections 156 (3) or 200 Cr.P.C (now under Section 175(3) or under Section 223 of Bhartiya Nagrik Suraksha Sanhita, 2023). He further submits that the controversy involved in the present matter has already been decided by the High Court of Allahabad in Misc. Bench No.24492 of 2020 : Waseem Haider Vs. State of U.P. Through Principal Secretary, Home Others vide judgment and order dated 14.12.2020 as well as by this Court in WPCR No. 333 of 2020 (Akhilesh Agrawal v. State of Chhattisgarh & Others) decided on 12.04.2023, dismissing the said petition, hence, the present petition be also dismissed in terms of the said order. 5. Accordingly, the present writ petition is dismissed with liberty to the petitioner to avail the appropriate remedy before appropriate Forum.
