The petitioner is the Pradhan of Alipur II Gram Panchayat and submitted applications against the private respondents/members of the Panchayat under Section 11(1) (d) of the West Bengal Panchayat Act, 1973 seeking their removal for absence in three consecutive meetings despite service of notice. The applications are yet to be considered. The petitioner seeks consideration of the same. It is a fact that there is no time frame under Section 11 of the Act for disposal of applications under the said provision of law. At the same time, the Prescribed Authority cannot sit tight over the applications for an indefinite period and choose not to dispose of the same. In view of the above, the Prescribed Authority and Sub Divisional Officer, Malda Sadar, being the 7th respondent herein, is directed to consider and dispose of the applications within four weeks from the date of communication of this order upon granting reasonable opportunity of hearing to all concerned including the 2 petitioner and the private respondents, in accordance with law. The decision taken by the authority shall be communicated to the parties within a week thereof. The writ petition is accordingly disposed of. There shall however, be no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to have been admitted.
