JUSTICE ARUN KUMAR JHA ORAL ORDER 3 28-07-2026 Heard learned counsel for the petitioner and learned APP for the State. 2. In the present case, the petitioner seeks bail in connection with Manpur P.S. Case No. 139 of 2025, registered for the offences under Sections 126(2), 127(2), 115(2), 109(1), 61(2), 85 and 3(5) of the BNS and Section ¾ of the Dowry Prohibition Act and later on added Section 80 of the BNS. 3. As per the prosecution case, on 28.08.2025, the informant got a phone call from her daughter about petitioner and other coaccused persons assaulting her. The daughter of the informant was married to the petitioner two years back. When the informant and her son reached the matrimonial home of her daughter, they found coaccused Manvi Kumari strangulating the daughter of the informant with dupatta. The daughter of the

No.36111 of 2026(3) dt.28-07-2026 2/4 informant was unconscious and she was taken to the hospital from where she was referred to PMCH and subsequently, she died on 10.09.2025. The informant further alleged that the accused persons had been demanding Rs.01 lakh in cash. 4. Learned counsel appearing on behalf of the petitioner submits that the petitioner is innocent and he has been falsely implicated in this case. No occurrence in the manner as alleged as ever taken place. The petitioner or his family members never demanded any dowry and for the last two years, there is no complaint in this regard. The whole prosecution story is not believable. The occurrence took place on 28.08.2025 and till 10.09.2025 the informant did not report the matter to the police. Even in the First Informant Report, there is no specific allegation against this petitioner and the allegation of strangulation is against coaccused Manvi Kumari. After 20 days of the alleged occurrence, the daughter of the informant died in her parental home.
The learned counsel further submits that the daughter of the informant tried to commit suicide and in this act she received some injuries and was not even able to talk as reported by the Investigating Officer. Learned counsel further submits that if the manner of occurrence is believed, not recording the statement of the victim is very surprising. Learned

Charge sheet has been submitted. 5. Learned APP appearing for the State opposes the submission made on behalf of the petitioner. Learned APP submits that the petitioner is husband of the deceased and the death occurred within two years of marriage. 6. Having regard to the fact and circumstances and submission made on behalf of the parties and considering the delay in lodging of FIR and further considering the doubtful nature of allegation against the petitioner, his clean antecedent, period of custody of the petitioner and submission of charge sheet against him, the petitioner is directed to be released on bail, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each to the satisfaction of learned ACJM-II, Nalanda at Bihar Sharif/concerned court, in connection with Manpur P.S. Case No. 139 of 2025, subject to the condition laid down under Section 480(3) of the BNSS and other following conditions: (i) One of the bailors will be a close relative of the petitioner.
