By the present petition, the petitioner has prayed for following reliefs:- “10.1 That, this Hon'ble Court may kindly be pleased to issue a writ in the nature of mandamus directing the respondents to consider and grant compassionate appointment to the petitioner in an appropriate post commensurate with his qualifications, within a stipulated time frame of 3 months from the date of order, in light of the demise of his father Late Gopi Dongre on 15.08.2021 and his application dated 24.11.2021. 10.2 That, this Hon'ble Court may kindly be pleased to direct the respondents to relax the time limit under Rule 16 of the Consolidated Revised Guidelines, 2013, if necessary, and expedite the process through the Administrative Department and Director, Urban Administration and Development Department, considering the humanitarian aspects and without further delay. 10.3 That, this Hon'ble Court may kindly be pleased to grant any other relief, as it may deems fit and appropriate.” 2. Learned counsel for the petitioner submits that the father of the petitioner was working with the respondent No. 4 and he died on 15/08/2021 therefore an application was made by the petitioner for consideration of his case of appointment on compassionate ground, the same has not been decided yet. 3 3. On instructions, Mr. Manas Vajpai, Advocate on behalf of Mr. Sandeep Dubey, Advocate submits that the respondent No. 4 has identified this petitioner to be eligible for consideration of their cases on appointment on compassionate ground in which the name of the petitioner has been forwarded to the Deputy Director Directorate of Urban Administration, Mahanadi Bhavan, Nawa Raipur, CG vide its letter dated 24.11.2021 and thereafter a reminder was also sent on 30/01/2025. He submits that no sanction post is available, hence case of the petitioner cannot be considered however, he fairly submits that the persons mentioned at serial No. 1 has been considered and has been given compassionate appointment. Therefore, the decision to sanction further post is within the domain of the department of Urban Administration State Government of CG. He prays that the Government of CG department of Urban Administration may be directed to take appropriate decision on the letter dated 24.11.2021 and reminder letter dated 30/01/2025 and thereafter so that in the sanctioned post either with the respondent No. 2 or any other local bodies, the case of the petitioner will be considered. 4. This proposition is not opposed by the petitioner or by the respondent No. 1 & 2. At this stage, this petition is disposed of and it is excepted that the Secretary/ Director/Dy. Director of Urban Administration, Mahanadi Bhavan, Nawa Raipur, CG will take appropriate decision on the letter dated 24.11.2021 and 4 reminder dated 30/01/2025 for redressal of the grievances of the petitioner and also considering that the petitioner has been identified by the respondent No. 3 for appointment on compassionate ground, an appropriate decision will be taken within the further period of 120 days from the date of receipt of copy of this order. The documents place before this Court is made part of the records. 5. Respondent No. 1- Secretary, Department of Urban Administration & Development as well as respondent No. 4- Commissioner, Municipal Corporation are directed to consider the case of the petitioner and decide the same within a period of 3 months. 6. With this observation, this writ petition is disposed of. Liberty is reserved in favour of the petitioner to file afresh petition, if any cause of action still subsists.
