These are the First bail application filed under Section 483 of the Bhartiya Nagrik Suraksha Sanhita 2023 for grant of regular bail to applicants, who have been arrested in connection with Crime No.SCC POCSO/20/2026, Crime No.10/2026 registered at Police Station – Mahila Thana Durg District Durg, (C.G.) for commission of offence punishable under Sections 65(1), 70(2), 351(3), 61(2), 64(2) (F), 64(2)(M) and 238 of BNS, 2023, Section 376(D)(A) and 376(2) (n) of Indian Penal Code and Sections 6 and 12 of POCSO Act, 2012 and Section 3(2)(V) fo SC and ST (Prevention of Atrocities) Act, 1989
2. The prosecution case, in brief, is that, a report was filed at Police Station Mahila Thana Durg District Durg, (C.G.) (Crime No. 10/2026) alleging that in the year of 2018 her aunt acquainted the prosecutrix and her mother with Govind Singh and the said Govind Singh took the prosecutrix and her mother at PWD Quarter for work, where the prosecutrix and her mother used to live in the said quarter.
In the last week of April, Govind Singh with his friend came and committed the alleged offence and threatened her. Based on these allegations, the applicants were charged under the aforesaid Sections. 3
3. Learned counsel for the applicants submits that the applicants are innocent. The victim and her mother have already been examined before the trial Court, and they have not supported the case of the prosecution. As per their statements, neither the victim nor her mother has supported the prosecution case. The victim has not identified the present applicants and has also stated that the applicants did not commit any of the alleged offences against her. He further submits that the applicants have been in judicial custody for more than five months, the charge-sheet has already been filed, and the conclusion of the trial is likely to take some time. Therefore, he prays that the applicants be released on bail. 4. Per contra, learned counsel for the State opposes the bail application. 5. Heard learned counsel for the parties and perused the case diary. 6. Considering the facts and circumstances of the case, and further considering the statements of the victim and her mother, further, conclusion of the trial may take some time, without commenting on the merits of the case, I am inclined to grant bail to the applicants. 7. Accordingly, bail applications are allowed. It is directed that applicants shall be released on regular bail, on their furnishing bail bond in sum of Rs.20,000/- each with one surety each in like sum to satisfaction of concerned Court. Applicants shall appear before trial Court on each and every date given to them by the said Court till
4 disposal of the trial. It is made clear that any observation made by this Court in this order shall not affect the trial of the case. 8. Office is directed to send a certified copy of this order to the concerned Trial Court for necessary information and compliance forthwith.
