1. The matter comes upon an application (I.A. No. 01/2026) under Section 151 of CPC seeking withdrawal of the present S.B. Civil First Appeal No. 898/2018, as the parties have settled their dispute amicably out of the Court with the prayer that the appellant be permitted to get the Court fee refunded.

Learned counsel appearing on behalf of the respondent-cross objector also admitted the fact that parties have settled their dispute amicably and also submits that cross-objection may also be dismissed as withdrawn.
3. Original settlement deed submitted by learned counsel for the appellant is taken on record.
4. In that view of the matter, the application (I.A. No. 01/2026) is allowed and learned counsel for the appellant as well as learned counsel for the respondents are permitted to withdraw the appeal and cross-objection.
5. Accordingly, S.B. Civil First Appeal No. 898/2018 and S.B. Cross Objection (Civil) No. 10/2019 are dismissed as withdrawn.
6. Pending application(s), if any, also stands disposed of.

Learned counsel for the appellant submits that he has already moved an application for refund of the Court fee filed in this appeal.
