Petitioner has filed this writ petition seeking following reliefs. Digitally signed by PRAVEEN KUMAR SINHA Date: 2026.01.30 10:42:50 +0530 2 / 3 “10.1 That, the Hon'ble Court may kindly be pleased to call for the records from the respondents pertaining to the petitioner's case. 10.2 That, the Hon'ble Court may kindly be pleased to pass an appropriate writ of mandamus, order or direction, directing the respondent no.3 to extend the benefit of House Allowances to the petitioner since august 2023 to till date and her name be deleted from the list as per annexure P/1. 10.3 This Hon'ble Court may further be pleased to grant any other relief which the Hon'ble Court deems fit and proper as per the nature of the case. An affidavit in support of this writ petition is filed herewith.” 2. Learned counsel for the petitioner submits that petitioner was initially appointed as Shikshakarmi Grade-III. Pursuant to order dated 01.07.2018, petitioner was absorbed in School Education Department and is now working as Assistant Teacher (LB). Petitioner is entitled for House Rent Allowance (HRA), however, benefit of HRA is not extended to her. Petitioner has submitted representation before respondent No.2 and 3, however, till date, representation submitted by petitioner has not been considered and decided. Therefore, a direction be issued to concerned respondents to take decision on the representations at the earliest and to disburse HRA in favour of petitioner from the date of her entitlement. 3. Learned counsel for the State submits that in view of limited prayer made by learned counsel for the petitioner for taking decision on representation, she is having no objection. She submits that representation submitted by the petitioner appearing to be of the year 3 / 3 2023 and therefore if the petitioner submits fresh representation it will be considered and decided in accordance with law.. 4. At this stage, learned counsel for petitioner submits that he may be permitted to submit fresh representation before the concerned authority. 5. On due consideration of submission of learned counsel for the parties, without entering into merit of the case, this writ petition at this stage is disposed of permitting the petitioner to submit fresh representation before respondents No. 2 & 3 and if such representation is submitted, concerned respondent authorities shall consider and decide the same in accordance with law, expeditiously, preferably within a period of 2 months from the date of receipt of representation.
