Learned advocate appearing for the petitioners submits that the alleged recovery from the present petitioners is 535 bottles of phensedyl. The petitioners are in custody for 8½ months. Charge-sheet has been submitted before the jurisdictional court and the prosecution has relied upon 13 witnesses in order to prove its case. As such, the petitioners may be released on bail. Learned advocate appearing for the State opposes the prayer for bail. I find that there are no criminal antecedents of the present petitioners and the trial would take some time considering the number of witnesses relied upon by the prosecution.
2 Having regard to the same, I am inclined to release the petitioners on bail. As such, the prayer for bail of the present petitioners is allowed. The petitioners, namely, Allarakha @ Ripanj, Tajmahal Sk, Jaharul Sk and Chatu Mallick @ Krishna Roy shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only) each with two sureties of Rs.10,000/- each, one of whom must be local to the satisfaction of the learned Judge, under NDPS Act, 4th Court, Paschim Medinipur. If on bail, the petitioners shall be physically present on each and every date before the learned trial court and shall not leave the district of Paschim Medinipur without prior permission of the learned special court. Thus, CRM(NDPS) 1067 of 2026 is allowed. Memo of Evidence submitted by the State be kept with the record. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of requisite formalities.
