(ORAL) On the oral request of learned Senior counsel for the petitioner, the State of Punjab is substituted with the State of Haryana as the respondent. Registry is directed to carry out necessary correction in the Memo of Parties. 2. Prayer in the present petition preferred by the petitioner under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short the ‘BNSS’) is for the grant of anticipatory bail in case FIR No.90 dated 13.05.2026 registered under Section 15-C of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short ‘the NDPS Act’) (Section 29 of the NDPS Act added later on), at Police Station City Narwana, District YAG DUTT 2026.07.10 17:21 I attest to the accuracy and authenticity of this order/judgment. CRM-M No.34788 of 2026 -2- Jind. 3. Status report by way of affidavit of Sh. Kamaldeep Rana, HPS, Deputy Superintendent of Police, Jind, District Jind, filed by learned State counsel in Court, is taken on record. 4. As per the case of the prosecution, on the intervening night of 12/13.05.2026, two persons namely Mahesh Rao Maratha and Gurcharan Singh alias Charna were apprehended on the basis of a secret information and 815 Kgs. of poppy husk was recovered from them. In their disclosure statements, they named the present petitioner stating that they had purchased the poppy husk from him and that further they had also been asked to deliver a part of the poppy husk to some other person. On the basis of the said disclosure statements, the petitioner was nominated as an accused in the present case. 5. Learned Senior counsel for the petitioner submits that the apart from the disclosure statements, which are not admissible in evidence, there is no other evidence to connect the petitioner with the two persons, who had been apprehended. He further submits that the petitioner is willing to join investigation and abide by any condition imposed by this Court. 6. Per contra, learned State counsel has opposed the prayer for the grant of anticipatory bail stating that there is a WhatsApp call between the petitioner and the co-accused. He further submits that the petitioner is involved in two other cases, i.e. (1) FIR No.190/2022 under Section 15-C of the NDPS Act, registered at Police Station Garhi and (2) FIR No.175/2020 under Sections 8, 15, 25 and 29 of the NDPS Act, registered YAG DUTT 2026.07.10 17:21 I attest to the accuracy and authenticity of this order/judgment. CRM-M No.34788 of 2026 -3- at Police Station Chandriya (Rajasthan). 7. I have considered the submissions made by learned counsel for the parties. 8. The antecedents of the petitioner are not clean. Two other cases under the NDPS Act already stand registered against him. 815 Kgs. of poppy husk (commercial quantity) was recovered from the main accused Mahesh Rao Maratha and Gurcharan Singh alias Charna. The allegation is that it is the petitioner, who had asked the main co-accused Mahesh Rao Maratha and Gurcharan Singh alias Charna to take the canter containing the poppy husk to Punjab. In the considered opinion of this Court, it is only on the arrest of the petitioner that other details shall be divulged. 9. That being so, this Court does not find it to be a fit case where the concession of anticipatory bail should be extended to the petitioner. 10. The instant petition is accordingly dismissed.
