Order No.03 Dated- 09.10.2026
Heard the parties.
This criminal miscellaneous petition has been filed at the instance of the petitioner for restoration of B.A. No. 4013 of 2026 to its original file.
Learned counsel for the petitioner submits that B.A. No. 4013 of 2026 was dismissed for non-compliance of the peremptory order of filing supplementary affidavit. It is next submitted that as the Secretary, DLSA, Pakur forwarded the said deposition to the Secretary, High Court Legal Services Committee on 07.08.2026 and the same was provided to conducting counsel only on 13.08.2026, hence, the said supplementary affidavit could not be filed within the stipulated time and the same resulted in dismissal of B.A. No. 4013 of 2026. It is further submitted that non-compliance of peremptory order was neither deliberate nor intentional. It is next submitted that the petitioner has very good grounds to agitate in the said B.A. No. 4013 of 2026 and unless B.A. No. 4013 of 2026 is restored to its original file, the petitioner will be highly prejudiced. Hence, it is submitted that B.A. No. 4013 of 2026 be restored to its original file.
Considering the aforesaid submission of the learned counsel for the petitioner and the facts of this case, B.A. No. 4013 of 2026 is restored to its original file to the stage at which, it was before its dismissal.
List B.A. No. 4013 of 2026 under the appropriate heading before the appropriate bench after a week.
