Learned counsel for the petitioners submits that the petitioners were appointed as State Tax Inspectors vide order dated 01.07.2022 pursuant to the recruitment process conducted by the respondents in the year 2022. It is submitted that under the applicable service conditions, the petitioners were placed on probation for a period of two years. Having successfully completed the prescribed period of probation and also having passed the departmental examination conducted in terms of the applicable rules, the petitioners have become eligible for confirmation and consideration for further promotional benefits. However, despite fulfillment of all the requisite conditions prescribed under the Chhattisgarh Commercial Tax Class-III (Executive) Recruitment and Conditions of Service Rules, 2022 (for short, "the Rules of 2022") read with the Chhattisgarh Civil 4 Services (General Conditions of Service) Rules, 1961 (for short, "the Rules of 1961"), the respondents have not taken any decision regarding confirmation of the petitioners. It is, therefore, prayed that an appropriate direction be issued to the respondents to consider the petitioners' claim in accordance with law. 2. Learned State counsel submits that if the petitioners submit a fresh representation before the Secretary, Department of Commercial Tax (respondent No. 1), raising their grievance, the same shall be considered and decided by the competent authority in accordance with the provisions of the Rules of 2022 read with the Rules of 1961. 3. Heard learned counsel for the parties and perused the material available on record. 4. Considering the submissions advanced by learned counsel for the parties, particularly the statement made by learned State counsel, and without expressing any opinion on the merits of the petitioners' claim, the present writ petition is disposed of with liberty to the petitioners to submit a fresh representation before respondent No. 1 within a period of 20 days from today. In the event such representation is submitted within the aforesaid period, respondent No. 1 shall consider and decide the same by passing a reasoned and speaking order, strictly in accordance with the provisions of the Rules of 2022 read with the Rules of 1961, within a further period of 50 days from the date of receipt of the representation. 5 5. It is made clear that this Court has not expressed any opinion on the merits of the petitioners' claim, and the competent authority shall take an independent decision in accordance with law. 6.
