1. By way of this petition, the petitioners have sought following reliefs:-
“i) That this Hon'ble Court may kindly be pleased to call for the entire records from the possession of the respondent authorities
3 pertaining to the case of the petitioners for its kind perusal. (ii) That, this Hon'ble Court may kindly be pleased to allow this petition and direct the respondent no.2/Commissioner to receive the appeal/case of the petitioners and hear the case and decide the matter after given proper opportunity of hearing to the petitioners in accordance with law. (iii) Any other relief or reliefs which this Hon'ble Court may deem fit or proper in the facts and circumstances of the case including cost of the litigation. 2. Learned counsel for the petitioners submits that when an appeal was moved before the Commissioner Raipur Division on 28.10.2025, it was duly received, however, the said authority subsequently refused to hear the matter and returned the appeal to the petitioners without assigning any proper reason. He submits that neither was an opportunity of hearing afforded to the petitioners nor was any date mentioned while returning the said appeal. He makes a limited prayer to dispose of this petition with a direction to the concerned Commissioner to accept the appeal and pass an appropriate order in respect of the reliefs sought by the petitioners, after affording a due opportunity of hearing. 3. Learned State counsel submits that once the appeal was received in the Court of Commissioner, Raipur Division, the concerned
4 authority ought to have passed an appropriate order in accordance with law. 4. Considering the facts and circumstances of the case and further considering the limited prayer made by learned counsel for the petitioners, this Court deems it appropriate to direct Respondent No. 2 i.e. Commissioner Raipur Division to accept the appeal of the petitioners and pass an appropriate order after giving a proper opportunity of hearing to the parties concerned. Ordered accordingly. 5. It is made clear that this Court has not expressed any opinion on the merits of the case. The Commissioner, Raipur Division is at liberty to pass appropriate order after hearing the matter and considering the aforesaid aspects of the matter.
The petitioners are directed to appear before the Commissioner, Raipur Division on 19.08.2026, and on that date, the Commissioner shall accept the appeal of the petitioners and pass an appropriate order thereon either on the same date or an early date thereafter. 6. With the aforesaid observations/directions, the writ petition stands
