JUSTICE M.NAGAPRASANNA ORAL ORDER Learned counsel appearing for the petitioners files a memo seeking withdrawal of the petition. The memo so filed reads as follows: "MEMO FOR WITHDRAWAL OF CRIMINAL PETITION WITH LIBERTY The Petitioners most respectfully submit as follows: - 3 - HC-KAR NC: 2026:KHC:34964 CRL.P No. 4607 of 2026 1. The above Criminal Petition was filed seeking appropriate reliefs in respect of the proceedings arising out of the complaint/FIR against the Petitioners. 2. This Hon'ble Court, by order dated 01.06.2026, was pleased to grant an interim order of stay in the above matter as far as Petitioner No.2 and 3 are concerned. 3. However, during the subsistence of the said interim order, the Respondent Police have filed the charge sheet on 25.06.2026, and the same has now been registered as C.C.No.62413/2026 on the file of the XXIX Additional Chief Judicial Magistrate. 4. In view of the subsequent filing of the charge sheet and registration of the criminal case, the present petition has become infructuous in its present form. The Petitioners are required to challenge the charge sheet and the consequential proceedings by filing a fresh Criminal Petition with appropriate pleadings and reliefs. 5. Therefore, the Petitioners crave leave of this Hon'ble Court to withdraw the above Criminal Petition, with liberty to file a fresh Criminal Petition challenging the charge sheet and all further proceedings in C.C. No.62413/2026, in accordance with law. 6. The Petitioners further submit that all contentions, including the contentions regarding the filing of the charge sheet during the subsistence of the interim order dated 01.06.2026, may kindly be kept open. WHEREFORE, the Petitioners most respectfully pray that this Hon'ble Court may be pleased to permit the Petitioners to withdraw the above Criminal Petition, with liberty to file a fresh Criminal Petition challenging the charge sheet and the proceedings in C.C.No.62413/2026, in the interest of justice and equity." 2.
