This anticipatory bail application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 has been filed by the Applicant who is apprehending his arrest in connection with Crime No.203/2026 registered at Police Station – Pali, District Korba (C.G.) for the offence punishable under Section SISTLA NEELIMA VISHNU PRIYA Digitally signed by SISTLA NEELIMA VISHNU PRIYA Date: 2026.07.22 17:58:34 +0530 2 64(2)(m) of BNS. 2. As per the prosecution case, on the basis of a written complaint lodged by the prosecutrix on 07.06.2026 at Police Station Pali, the present FIR was registered against the Applicant. It is alleged that the victim became acquainted with the Applicant in the year 2015 and that they remained in contact. It is further alleged that in the year 2018, the Applicant, on the false promise of marriage, established physical relations with her for the first time at her residence and thereafter continued to have physical relations with her on the same pretext. It is alleged that the last such incident occurred on 14.05.2026 at the victim's residence and that whenever she asked the Applicant to marry her, he kept misleading her, thereby subjecting her to physical and mental harassment. Accordingly, the present crime was registered against the Applicant. Hence, this application. 3. Learned Counsel for the Applicant submits that the Applicant is innocent and has been falsely implicated in the present case. It is contended that the Applicant and the victim belong to the same village and the same caste and were well acquainted with each other. It is further submitted that the victim intended to marry the Applicant and upon his refusal, has lodged the present false FIR. It is argued that the 3 allegation that the Applicant had been establishing physical relations with the victim continuously from the year 2018 till 2026 is inherently improbable, particularly when the victim is a major aged about 32 years. It is further submitted that another crime bearing Crime No.167/2026 under Section 69 of the BNS has also been registered against the Applicant by another major woman aged about 28–29 years with a similar allegation with the intention of preventing the Applicant's marriage, in which he has already been granted regular bail by the learned Additional Sessions Judge, Pendra Road, District Gaurela-Pendra-Marwahi. He lastly submits that conclusion of the trial is likely to take considerable time, therefore, the Applicant may be granted anticipatory bail. 4. On the other hand, learned State Counsel opposes the bail application. 5. Considering the submissions advanced by learned Counsel for the parties, the material available in the case diary, the nature of allegations, the fact that the victim is a major aged about 32 years and as per her own statement recorded under Section 183 of the BNSS, she had known the Applicant since the year 2015 and remained in a relationship with him since the year 2018, custodial interrogation of the Applicant does not appear to be necessary, the trial is likely to take 4 considerable time for its conclusion and without further commenting anything on the merits of the case, this Court is of the considered opinion that it is a fit case to allow the application. 6. 6. Accordingly, the instant MCRCA is allowed and it is directed that in the event of arrest of the Applicant – Narendra Kumar Raj, on executing a personal bond with one surety in the like sum to the satisfaction of the arresting Officer, he shall be released on bail on the following conditions:- (a) The Applicant/s shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him/her/them from disclosing such fact to the Court. (b) The Applicant/s shall not act in any manner which will be prejudicial to fair and expeditious trial. (c) The Applicant/s shall appear before the trial Court on each and every date given to him/her/them by the said Court till disposal of the trial. (d)The Applicant/s and the surety shall submit a copy of his/her/their adhaar card along with a colored postcard full size photo having printed the adhaar number on it, which shall be verified by the trial Court.
