This petition has been filed under Section 528 of BNSS, 2023 (erstwhile 482 of Cr.P.C) for quashing of impugned order dated 13.04.2023 (Annexure P-9) passed by the learned Judicial Magistrate 1st class, Jalandhar, Punjab wherein the petitioner was declared as proclaimed Offender in FIR No.028 dated 06.02.2020 u/s 323/324/341/148/149 IPC (Section 326 IPC added later on) at Police Station Rama Mandi, District Police Commissionerate Jalandhar, Punjab with a further prayer to stay the operation and implementation of the impugned order. 2. Learned counsel for the petitioner submits that the petitioner could not appear before the learned trial Court on the date fixed as he had gone abroad. As such, petitioner was declared proclaimed offender and his bail order was cancelled and his bail bonds and surety bonds were also cancelled and forfeited to the State vide order dated 13.04.2023 (Annexure P- 9). I have heard the submissions made by the learned counsel for the petitioner and gone through the case file. 6. In view of the limited prayer made by the petitioner, this Court does not find any legitimate ground to interfere in the impugned order dated 13.04.2023 passed by the learned Judicial Magistrate 1st class, Jalandhar. However, in case the petitioner surrenders before the trial Court within next 07 working days from today and moves an application for grant of regular bail, the same shall be considered and decided by the Court concerned within a period of three days. 7.
