This is the first bail application filed under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant who has been arrested in connection with Crime No.229/2026 registered at Police Station Bilha, District Bilaspur (C.G.) for the offence under Sections 296, 115 (2), 315 (3), 118 (2) & 3 (5) of the BNS. Case of the prosecution is that complainant, Ghanshyam Jogi, lodged a report at Police Station Bilha stating that on 29.04.2026, the wedding of Sheshant Ghritlahare, the son of his nephew-in- law was being celebrated. The wedding procession (Baraat) had arrived at the residence of Lal Bahadur Kurre in Village Bitkuli, Bilha. During the wedding ceremony, the members of the wedding procession were dancing. On 30.04.2026, between 1:00 a.m. and 2:00 a.m., while people were dancing near Ambedkar Chowk in Village Bitkuli, an unknown person who was dancing accidentally came in contact with the complainant's nephew, Jay Joshi. When Jay Joshi asked him to dance properly, the said unknown person and his associates started abusing him in the name of his mother and sister. When the complainant's nephew, Akash Dahariya, objected to the abusive language and asked them to stop, the unknown person and his associates assaulted Jay Joshi by hands and fists. When Akash Dahariya, Ayan Joshi, and Sujit Jogi (the son of Ayan Joshi) intervened, they were also attacked with fists and fists and with a sharp-edged object. As a result, Akash Dahariya sustained an injury on his left elbow, and Sujit Jogi sustained an injury near his navel (abdomen). Thereafter, Sujit Jogi was admitted to Shri Ram Care Hospital, Bilaspur, and the offence was registered against the present applicant. Hence the bail application. 3. It has been argued by learned counsel for the applicant that the applicant is innocent and has been falsely implicated in the crime. 3 The incident has taken place in the marriage procession and during the incident, the applicant and his companions have also been assaulted by the complainant party. The applicant does not have any criminal antecedent. The applicant is in jail since 25.6.2026. Therefore, the applicant may be released on bail. 4. On the other hand, learned counsel appearing for the State/non- applicant would oppose the bail application and submit that the applicant has caused injuries by knife on the abdomen of the injured and the injuries are grievous in nature. Therefore, the present bail application may be rejected. 5. I have heard learned counsel appearing for the parties and perused the case diary. 6. Taking into consideration the facts and circumstances of the case and the fact that the applicant has caused injuries by knife on the abdomen of the injured and the injuries are grievous in nature, this Court is not inclined to release the applicant on bail. 7. Accordingly, the bail application of applicant – Paklu @ Yaddast Banjare, involved in Crime No.229/2026 registered at Police Station Bilha, District Bilaspur (C.G.) for the offence under Sections 296, 115 (2), 315 (3), 118 (2) & 3 (5) of the BNS, is rejected.
