Order No.02
Date: 05.10.2026
1. The present writ petition has been filed seeking issuance of direction upon the concerned respondent to accept the rent and issue up-to-date rent receipts in favour of the petitioner in respect of the land appertaining to Khata No. 30, Plot No. 65, situated at Mouza-Gutwa, measuring an area of 28 decimals (hereinafter referred to as the ‘said land’), recorded in the name of the petitioner and further to take appropriate steps for regularization of the Jamabandi, which has been continuously running in his name.
2.
Learned counsel for the petitioner submits that the said land was recorded in the Revisional Survey Khatiyan of the year 1934-35 in the names of Gandur Lohar, Lodhar Lohar and Lodha Lohar, who were in peaceful possession of their

respective shares in the said land. Thereafter, on 15.12.2000, the successors of the recorded tenants sold the said land in favour of Ajit Kumar Bariyar and Hiralal Tiwari by way of registered Sale Deed No.11392. After coming into peaceful possession of the said land, the same was duly mutated in their favour. Subsequently, Ajit Kumar Bariyar and Hiralal Tiwari sold the said land to the petitioner by way of two sale deeds i.e., Sale Deed No. 137 dated 28.01.2016 and Sale Deed No. 1215 dated 15.07.2016. Thereafter, the petitioner came in peaceful possession of the said land. 3. It is further submitted that, after coming into peaceful possession of the said land, the petitioner applied for mutation and, upon due enquiry, the respondent No. 5 issued correction slips in Case Nos. 1550/R27 2015-16 and 1059/R27 2016-17. The name of the petitioner was also entered in Register-II and he continued to pay rent to the State till the year 2019-20. It is also submitted that the petitioner and his family have been using the said land for commercial purposes. A nursery is being run over the said land by the petitioner’s tenant, and an electricity connection is also available there. Despite that, the respondent no.5 has not been issuing rent receipt for the said land after 2019-20. 4. Aggrieved with the said situation, the petitioner represented the respondent authorities, including respondent no. 5, copies of which have been annexed as Annexure-4 series to the present writ petition. However, the said representations were

not considered, which compelled the petitioner to prefer the present writ petition. 5. Mr. Manoj Kumar, learned G.A.-III, appearing on behalf of the respondents, submits that if the petitioner prefers a fresh representation on the present issue before the respondent no.5, an appropriate decision in accordance with law will be taken by the said respondent within a stipulated time frame. 6.
Having heard the learned counsel for the parties and considering the nature of the prayer made in the present writ petition, without entering into the merit of the case, the petitioner is given liberty to prefer a fresh representation on the present issue before the respondent no.5. On receipt of the said representation, the said respondent after providing due opportunity of hearing to the petitioner/his representative and on verifying the relevant records, shall take an appropriate informed decision in accordance with law within a period of six weeks from the date of filing of the said representation. 7. The writ petition is, accordingly, disposed of with aforesaid liberty and direction. (Rajesh Shankar, J.) Rohit/ 05.10.2026 Uploaded on 05.10.2026
