APHC010718062025 IN THE HIGH COURT OF ANDHRA PRADESH AT AMARAVATI (Special Original Jurisdiction) [3328] THURSDAY,THE EIGHTH DAY OF JANUARY TWO THOUSAND AND TWENTY SIX PRESENT THE HONOURABLE SRI JUSTICE GANNAMANENI RAMAKRISHNA PRASAD WRIT PETITION NO: 36650 & 36652 OF 2025 Between: 1. GANGISETTI SIVA RAMA KRISHNA Counsel for the Respondent(S): 1. P NARAHARI BABU 2 WRIT PETITION NO: 36652 OF 2025 Between: 1. BANDI SAMBASIVA RAO, S/O. PUMA CHANDRA RAO AGED ABOUT 46 YEARS OCC ADVOCATE R/O. FLAT NO. 502 SRI VENKATADRI RESIDENCY VANI NAGAR KANKIPADU KRISHNA DISTRICT - 521151 ...PETITIONER AND 1. THE BAR COUNCIL OF AP, REPRESENTED BY ITS SECRETARY GROUND FLOOR AP HIGH COURT BUILDINGS AT NELAPADU AMARAVATHI - 522239 2. THE BAR COUNCIL OF INIDA, REPRESENTED BY ITS SECRETARY OFFICE IS LOCATED AT 21 ROSE AVENUE INSTITUTIONAL AREA NEAR BAL BHAWAN NEW DELHI- 110002 ...RESPONDENT(S): Counsel for the Petitioner: 1. GANGISETTI SIVA RAMA KRISHNA Counsel for the Respondent(S): 1. P NARAHARI BABU 3 The Court made the following ORAL COMMON ORDER: Heard Sri G. Uma Sankar, Ld. Counsel appearing through online for the Writ Petitioners, Sri P. NarahariBabu, Ld. Counsel for the Respondent No.1 and Sri G. Venkata Reddy, Ld. Counsel for the Respondent No.2. 2. In both these Writ Petitions, the Writ Petitioners have not been able to place on record the essential requirement for enlisting an Advocate on the eligible Voters List namely the Certificate of Practice along with other proof of five Vakalats. In both the matters, the Writ Petitioners have not placed any material on record to indicate that they have in fact obtained Certificate of Practice and also ready with five Vakalatnamas. 3. On query made by this Court to the Ld. Counsel for the Writ Petitioners, Ld. Counsel for the Writ Petitioners would submit that the Certificate of Practice submitted by the Writ Petitioner in W.P.No.36652 of 2025 had some defect and it was lying with the Bar Council of Andhra Pradesh since 2023. It appears that there is no proper due diligence on the part of the Writ Petitioner from 2023 to till date. This apart, it is a matter of common knowledge that the Hon’ble Supreme Court had issued various directions from time to time in the case of M.Vardhan Vs. Union of India in W.P.(C) No.1319 of 2023 and the directions given by the Hon’ble Supreme Court were published widely including the Newspapers. At least during this time, the Writ Petitioner ought to have exercised due diligence in approaching the Bar Council of Andhra Pradesh well in advance to sort out the issues since the Certificate of Practice that was produced by the Writ Petitioner was pending for want of curing certain defects before Bar Council of Andhra Pradesh. 4. In the present situation, where the final Voters List has already been published on 29.12.2025, and that the Bar Council of Andhra Pradesh has already issued Notification on 03.01.2026, this Court is of the opinion that 4 the present Writ Petitioner has woken-up from his slumber late and therefore, this Court is not inclined to entertain this Writ Petition No.36652 of 2025. 5. Insofar as the Writ Petitioner in W.P.No.36650 of 2025 is concerned, Ld. Counsel for the Writ Petitioner has filed better Affidavit. The better Affidavit contains copy of the Declaration Form submitted by the Writ Petitioner which is attested by the President, Bezawada Bar Association, Vijayawada dated 11.09.2025. He would submit that when this Court has enquired as to the proof of submission of this Declaration Form, Ld. Counsel for the Writ Petitioner would submit that this copy was submitted to Vijayawada Bar Association but no acknowledgment was obtained. Since this Writ Petitioner has submitted the Declaration Form to the Vijayawada Bar Association, the Writ Petitioner would be required to approach the Vijayawada Bar Association to enquire about the status of the Declaration. 6. With these observations, both the Writ Petitions are dismissed as being devoid of any merit. No order as to costs. 7. Interlocutory Applications, if any, stand closed in terms of this order. ______________________________________ GANNAMANENI RAMAKRISHNA PRASAD, J Date: 08.01.2026 MNR 5 237 HON'BLE SRI JUSTICE GANNAMANENI RAMAKRISHNA PRASAD WRIT PETITION NOS: 36650 & 36652 OF 2025 Dt: 08.01.2026 Mnr
