JUSTICE S VISHWAJITH SHETTY ORAL ORDER Accused in Crime No.42 of 2026 registered by Mandya West Police Station, Mandya for the offences punishable under Section 126(1), 352, 109 and 351(2) of BNS, 2023, is before this Court in this petition filed under Section 483 of BNSS, 2023 seeking regular bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.42 of 2026 was registered by Mandya West Police Station, Mandya for the aforesaid offences against the petitioner herein, based on the first - 3 - HC-KAR NC: 2026:KHC:35275 CRL.P No. 7157 of 2026 information dated 11.04.2026 received from Ullasa Kumar M.U., friend of injured Rohith K. During the course of investigation, the petitioner was arrested on 14.04.2026 and remanded to judicial custody. His bail application filed before the jurisdictional Sessions Court in Crl.Misc.No.339 of 2026 was rejected on 06.05.2026. Therefore, he is before this Court. 4. In the first information dated 11.04.2026 the first informant has stated that he and injured Rohith.K., are working in a shop belonging to one Dhanush. The petitioner was also working along with the first informant and the injured in the very same shop. On 10.04.2026 at about 10.30 p.m. after closing the shop, the first informant and the injured Rohith.K., went towards their scooter. At that time, one person wearing a mask, all of a sudden snatched the scooter key and thereafter, he abused Rohith.K for the reason that he was loving his girlfriend. When Rohith.K tried to escape, the said person allegedly assaulted him with an iron rod and after - 4 - HC-KAR NC: 2026:KHC:35275 CRL.P No. 7157 of 2026 criminally intimidating Rohith.K and the first informant, he went away. 5. On enquiry, Rohith.K., allegedly informed the first informant that the assailant was the petitioner. It is under these circumstances FIR was registered against the petitioner. The investigation of the case is completed and the charge sheet has been filed. Petitioner is in custody in the present case for the last three months. In the other criminal case which was registered against him, he has been now acquitted. The victim, who had suffered grievous injuries in the incident, was admitted to the hospital for three days and thereafter discharged. His condition is now stated to be stable. 6. Under the circumstances, I am of the opinion that the prayer made by the petitioner for grant of regular bail needs to be answered affirmatively subject to appropriate conditions. The petitioner is directed to be enlarged on bail in Crime No.42 of 2026 registered by Mandya West Police Station, Mandya for the offences punishable under Section 126(1), 352, 109 and 351(2) of BNS, 2023, subject to the following conditions: a) The petitioner shall execute personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future; - 6 - HC-KAR NC: 2026:KHC:35275 CRL.P No. 7157 of 2026 e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off.
