Learned advocate for the de facto complainant enters appearance and on instructions submits that de facto complainant has no objection if the petitioner’s anticipatory bail is granted. Learned advocate for the State is present. I have taken into account that the case has been registered under Sections 316(2)/318(4)/61(2) of the Bharatiya Nyaya Sanhita, 2023. The case was registered on 18.10.2025. Having considered the nature of the transaction which took place and the submissions of the de facto complainant, I am inclined to grant anticipatory bail to the 2 present petitioner. As such, the prayer for anticipatory bail of the petitioner is allowed. Accordingly, in the event of arrest, the petitioner viz., Biswajit Ghosh shall be released on bail to the satisfaction of the Arresting Officer and also be subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973 corresponding to Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. Let the instruction submitted by the learned advocate appearing for the de facto complainant be kept with the record. The application for anticipatory bail, being CRM (A) 111 of 2026, is, thus, disposed of. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
