Since the above mentioned two bail applications arises out of same crime number, they are clubbed together and are being disposed of by this common order. 2. These are the first bail applications filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) for grant of regular bail to the applicants who have been arrested in connection with Crime No. 600/2025 registered at Police Station Tikrapara Raipur District- Raipur (C.G.), for the offence punishable under Section 21(c), 27, 27(a) & 29 of the Narcotic Drugs and Psychotropic Substances Act, 1985 and Section 111 of BNS. 3. Case of the prosecution, in brief, is that on the basis of secret information, police conducted a raid and recovered commercial quantity of “chitta” from co-accused persons. During investigation, the applicants Sheikh Sahil @ Konda and Mohd. Imran Khan were found involved in an organized drug network, wherein Sahil used WhatsApp and UPI transactions to purchase and sell chitta, while Imran facilitated online payments and received commission. 3 It is alleged that both the applicants, in conspiracy with other co- accused, were engaged in illegal trafficking of narcotic substances and spreading the drug network for financial gain. Hence, the bail applications. 4. Learned counsel for the applicants submits that the applicants have been falsely implicated in this case and applicant, Sheikh Sahil is in jail since 15.09.2025 and applicant, Mohd. Imran Khan is in jail since 06.10.2025. He further submits that the mandatory provisions with regard to search and seizure were not complied with in this case. He also submits that the conclusion of the trial may take quite long time. Accordingly, he prays for enlarging the applicants on regular bail. 5. Learned counsel appearing for the State/non-applicant opposes the bail applications and submit that the charge-sheet has been filed in the present case before the competent Court. She further submits that the quantity of contraband article i.e. 412.87 grams of chitta was recovered in the present case, which is much above the commercial quantity as notified under the NDPS Act. She also submits that the present applicants in conspiracy with other co- accused, were actively involved in the illegal trade of “chitta,” wherein Sheikh Sahil used WhatsApp and UPI transactions to purchase and sell narcotics and operated a distribution network for financial gain, while Mohd. Imran Khan facilitated the transactions by transferring money to suppliers, sharing payment 4 details, and receiving commission, thereby assisting and supporting the drug trafficking activities. Moreover, the bail applications of four of the co-accused persons, namely, Shishir Rai, Ramanjeet Saluja, Pradeep Gendre and Lakshya Parifal Raghav have already been rejected by this Court vide orders dated 23.02.2026, 23.03.2026 and 27.02.2026 in MCRC Nos.7965 of 2025, 10347 of 2025, 2636 of 2026 and 2028 of 2026. Therefore, the applicants are not entitled for grant of bail. 6. I have heard learned counsel appearing for the parties and perused the case diary. 7. From perusal of the record, it transpires that the contraband articles i.e. 412.87 grams of chitta, involved in the present case is much above the prescribed commercial quantity threshold, furthermore, the allegation against Sheikh Sahil @ Konda and Mohd. Imran Khan is that, in conspiracy with other co-accused, they were actively involved in an organized network for illegal trafficking of “chitta.” Sheikh Sahil is alleged to have procured and sold the contraband by contacting suppliers through WhatsApp, making payments via UPI (including through accounts linked to his wife), and coordinating delivery through video locations, as well as facilitating further sale through other associates, he also allegedly kept a country-made pistol to intimidate others. Mohd. Imran Khan is alleged to have assisted in the operation by transferring money online to the suppliers on behalf of Sahil, 5 sending transaction screenshots, and receiving commission for his role. Thus, both are accused of financially facilitating and actively participating in the purchase and sale of narcotic substances for monetary gain, as such, it is an organized crime and it cannot be a case of false implication. Further considering the fact that the bail applications of four of the co-accused persons, namely, Shishir Rai, Ramanjeet Saluja, Pradeep Gendre and Lakshya Parifal Raghav have already been rejected by this Court vide orders dated 23.02.2026, 23.03.2026 and 27.02.2026 in MCRC Nos.7965 of 2025, 10347 of 2025, 2636 of 2026 and 2028 of 2026. 8. Accordingly, the bail applications of the applicants - Sheikh Sahil @ Konda and Mohd. Imran Khan, involved in Crime No. 600/2025 registered at Police Station Tikrapara Raipur District- Raipur (C.G.), for the offence punishable under Section 21(c), 27, 27(a) & 29 of the Narcotic Drugs and Psychotropic Substances Act, 1985 and Section 111 of BNS, are rejected. 9. Needless to say that the trial Court concerned is at liberty to proceed and conclude the trial expeditiously. 10.
