Learned counsel further submits that the Ejectment Suit No. 284 of 2007 is moved to the subsequent stages and, therefore, he does not want to press the present petition, i.e., CO 1039 of 2021 under the instruction of legal heirs of late Sri Pratap Kumar Mitra. 1. In view of the submissions made, the petition is dismissed as withdrawn. 2. Learned counsel for the opposite parties has placed on record, the decree passed in the ejectment suit. 2 3.
