JUSTICE S VISHWAJITH SHETTY ORAL ORDER Accused No.3 in Crime No.198/2026 registered by the Ramamurthy Nagar Police Station, Bengaluru, for the offences punishable under Sections 103(1) read with Section 3(5) of Bharatiya Nyaya Sanhita (for short, 'BNS') 2023, is before this Court in this Criminal Petition filed under Section 483 of Bharatiya Nagarak Suraksha Sanhita, 2023, seeking regular bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.198/2026 was registered by the Ramamurthy Nagar Police Station, Bengaluru, for the aforesaid offences against S.Yuvaraju and Gangaraju, based on first information dated 22.03.2026, received from Lakshmi, mother of deceased Kiran. In the said case, the petitioner was arrested on 23.03.2026 and remanded to judicial custody. After - 3 - HC-KAR NC: 2026:KHC:34982 CRL.P No. 7446 of 2026 completion of the investigation, a charge-sheet has been filed against three persons; the petitioner is arrayed as accused No.3 in the charge-sheet. His bail application filed before the jurisdictional Sessions Court in Crl.Mis.No.25359/2026 was rejected on 02.05.2026. Therefore, the petitioner is before this Court. 4. Perusal of the material on record would go to show that petitioner's name is not found in the FIR and during the course of the investigation, he was arrested on 23.03.2026 and remanded to judicial custody. In the charge-sheet, which is filed subsequently, it is alleged that accused Nos.1 to 3 are friends and they used to consume alcohol together. The deceased Kiran used to often request the accused persons to provide him alcohol, and in the event they did not provide it, he was abusing and assaulting them. 5. On 21.03.2026 at about 07:00 p.m., when accused Nos.1 to 3 were consuming alcohol in the autorickshaw belonging to accused No.1, deceased Kiran came there and allegedly asked them to provide him liquor. Accused persons allegedly refused to provide liquor to deceased Kiran and went - 4 - HC-KAR NC: 2026:KHC:34982 CRL.P No. 7446 of 2026 away. In the early hours of 22.03.2026, deceased Kiran allegedly once again met the accused persons who were gambling along with others and requested them to provide him alcohol. The accused persons allegedly refused to provide alcohol to Kiran and went away. Subsequently accused Nos.1 to 3 decided to murder Kiran, who was often troubling them. And in furtherance of this, accused No.1 has assaulted the deceased Kiran with a metal rod on his head and other parts of the body and accused No. 2 supported accused No.1 to commit the murder by keeping a watch. Accused No.3 allegedly was sitting inside the autorickshaw of accused No.1. Undisputedly, accused No.3, who is the petitioner herein, has no other criminal antecedents. 6. Under these circumstances, the following:- ORDER (i) The petition is allowed. (ii) The petitioner/accused No.3 is directed to be enlarged on bail in Crime No.198/2026 registered by the Ramamurthy Nagar Police Station, Bengaluru, for the offences punishable - 5 - HC-KAR NC: 2026:KHC:34982 CRL.P No. 7446 of 2026 under Sections 103(1) read with Section 3(5) of BNS, 2023, subject to the following conditions: a) The petitioner shall execute personal bond for a sum of Rs.1,00,000/- (Rupees One Lakh only) with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts there appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future; e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against them is disposed off.
