Charge-sheet has been submitted before the jurisdictional court and the prosecution has relied upon 14 witnesses in order to prove its case. Learned advocate appearing for the State opposes the prayer for bail. Having considered the period of detention of the present petitioner for 8 months and that the trial would take some time, I am inclined to release the petitioner on bail. As such, the prayer for bail of the present petitioner is allowed. The petitioner, namely, Samim Sk. @ Leul shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties of Rs.10,000/- each, one of whom must be local to the satisfaction of the learned Judge, 2 under NDPS Act, 2nd Court, Berhampore, Murshidabad. If on bail, the petitioner shall be physically present on each and every date before the learned trial court and shall not leave the district of Murshidabad without prior permission of the learned special court. Thus, CRM(NDPS) 1058 of 2026 is allowed. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
