Singh … for the State-respondent(s) Learned advocate for the petitioner submits that the petitioner is in custody for one year two months and out of the 15 witnesses cited in the charge-sheet only two witnesses till date have been examined. These two witnesses are the independent seizure list witnesses, who, according to the petitioner, have turned hostile. Learned advocate for the State opposes the prayer for bail. Having considered the quantum of seizure which is 511 gm of brown sugar, the evidence of the seizure list witnesses as well as the factum of detention of the present petitioner, I am of the view that some time will be required 2 to take the trial to its logical conclusion. Therefore, I am inclined to enlarge the petitioner on bail. Hence, the prayer for bail of the petitioner is Allowed. Accordingly, the petitioner viz, Abdul Karim shall be released on bail upon furnishing bond of Rs.20,000/-(Rupees Twenty Thousand only), with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local, to the satisfaction of the learned Judge, Special Court (NDPS Act), 2nd Court, Berhampore, Murshidabad. If on bail, the petitioner shall also make himself physically available on each and every date so fixed by the learned Special court/trial court and shall not leave the district of Murshidabad without prior permission of the learned Special court/trial court.
