This is the second bail application filed under Section 483 of the BNSS for grant of regular bail to the applicant who has been arrested in connection with Crime No. 70/2024 registered at Police Station - Saraipali, District – Mahasamund (C.G.), for the offence punishable under Section 20(b)(ii)(C) of Narcotic Drugs and Psychotropic Substances Act. 2. The earlier bail application of the applicant being MCRC No. 1256 of 2025 was rejected by this Court vide order dated 13.02.2025 on merits. 3. The prosecution case, in brief, is that the police of Police Station Saraipali, District Mahasamund (C.G.), received secret information from ABHISHEK SHRIVAS Digitally signed by ABHISHEK SHRIVAS Date: 2026.07.22 16:49:27 +0530 2 an informant that the present applicants were in possession of illegal contraband ganja. Acting upon the said information, the police conducted a search and allegedly recovered and seized 120 kilograms of ganja from the possession of the present applicants. Thereafter, the applicant was arrested and the case was registered by the police. 4. Learned counsel for the applicant submits that this is the second bail application filed by the applicant. The first bail application was rejected by this Court on merits vide order dated 13.02.2025. She further submits that the co-accused, namely, Ramswaroop Jat, has already been enlarged on bail by the Hon'ble Supreme Court in SLP (Crl.) No. 18797/2025 vide order dated 06.04.2025. It is submitted that the case of the present applicant is identical to that of the said co-accused and, therefore, on the ground of parity, the applicant is also entitled to be enlarged on regular bail. 5. On the other hand, learned State counsel opposes the bail application and submits that although the co-accused, namely, Ramswaroop Jat, has been enlarged on bail by the Hon'ble Supreme Court in SLP (Crl.) No. 18797/2025 vide order dated 06.04.2025, the case of the present applicant stands on a different footing. It is submitted that the said co- accused has no criminal antecedents under the NDPS Act, whereas the present applicant has 01 criminal antecedent under the NDPS Act of the year 2024. Therefore, the principle of parity is not applicable to the present applicant, and accordingly, it is prayed that the bail application be dismissed. 6. I have heard learned counsel appearing for the parties and perused the case diary. 7. Considering the facts and circumstances of the case, the nature and gravity of the offence, and particularly the fact that the present applicant 3 has 01 criminal antecedent under the NDPS Act, whereas the co- accused, Ramswaroop Jat, who has been enlarged on bail by the Hon'ble Supreme Court, has no such criminal antecedent, this Court is of the considered opinion that the case of the present applicant stands on a different footing and, therefore, the principle of parity is not applicable. 8. Accordingly, the second bail application of the applicant – Vinod Singh, filed under Section 483 of the BNSS involved in Crime No. 70/2024 registered at Police Station - Saraipali, District – Mahasamund (C.G.), for the offence punishable under Section 20(b)(ii)(C) of Narcotic Drugs and Psychotropic Substances Act, is rejected. 9.
