THIS PETITION, COMING ON FOR PRELIMINARY HEARING, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR. JUSTICE SURAJ GOVINDARAJ ORAL ORDER 1. The petitioner is before this Court seeking for the following reliefs: 1. Issue a writ or such other order in the nature of certiorari to quash the enquiry initiated by formation of committee vide letter bearing No.24- 07018(05)/1/2023-RC Blore/CD/Conf dated 10/05/2024 and 15.05.24 vide office order No.95/2024 and 106/2024 produced ANNEXURE - L issued by R3. 2. Pass such other orders as this Hon'ble Court deems fit to grant in the interest of justice and equity. 2. On a complaint lodged by respondent No.4, respondent No.1 initiated enquiry against the petitioner. The respondent No.4-Paralympic Committee of India has subsequently withdrawn the complaint vide letter dated 20.08.2024 at Annexure- M, which has been further communicated on 08.11.2024 and 06.12.2024 which has been communicated to respondent No.1 again on - 3 - HC-KAR NC: 2026:KHC:34924 WP No. 19661 of 2025 08.11.2024 and a letter has been issued to the petitioner on 26.12.2024. 3. An affidavit of the Secretary of the Paralympic Committee of India has also been filed stating that on a review being conducted of the complaint they have come to a conclusion that there is no lapse on the part of the petitioner and as such the Sports Authority of India had been informed about the withdrawal of the complaint. 4. In view of the aforesaid letters and the affidavit which has been filed, the question of the enquiry proceeding against the petitioner when the complaint itself has been withdrawn would not arise. As such, this Court passed the following; ORDER i. The writ petition is allowed. ii. A certiorari is issued, letter bearing No.24- 07018(05)/1/2023-RC Blore/CD/Conf dated 10/05/2024 and 15.05.2024 vide office order No.95/2024 and 106/2024 issued by respondent No.3 at Annexure-L is hereby quashed.
