IN THE HIGH COURT OF ORISSA AT CUTTACK ABLAPL No.1144 of 2026 Sarat Malik @ Sharat Chandra Malika & others …. Petitioners Mr. R.K. Sarangi, Advocate -Versus- State of Odisha …. Opposite Party Mr. S.K.Lena, ASC CORAM: MR. JUSTICE R.K. PATTANAIK Order No. ORDER 25.02.2026 01. 1. Heard learned counsel for the respective parties. 2. Instant petition has been filed under Section 482 BNSS by the petitioners seeking pre-arrest bail in connection with Panikoili P.S. Case No.10 of 2026 corresponding to C.T. Case No.73 of 2026 pending in the court of learned J.M.F.C., Jajpur Road on the grounds stated. 3. Perused the FIR as at Annexure-1. For the alleged incident, as it appears, a counter FIR has been lodged vide Annexure-2. In course of hearing, it is claimed that there has been a settlement between parties on 31st January, 2026. A copy of the settlement styled as ‘Chukti Patro’ between the parties is produced by learned counsel for the petitioners along with a memo, which is taken on record. The Court finds that petitioner No.6 is the husband of the informant wife and others are her in-laws. Considering the fact of compromise reached at between both the sides in the meantime as made to appear from the ‘Chukti Patro’, this Court is of the view that the petitioners should instead be directed to surrender before the learned court below seeking regular bail and release with a proper notice to the informant confirming the claim of such settlement instead of granting pre-arrest bail to them as has been demand at present. 4. Accordingly, it is ordered. 5. In the result, the ABLAPL is disposed of with the direction as aforesaid. It is directed that in the event, the petitioners surrender before learned J.M.F.C., Jajpur Road in connection with Panikoili P.S. Case No.10 of 2026 corresponding to C.T. Case No.73 of 2026 within fifteen days from today and move an application pleading compromise between them, it shall be entertained and disposed of with a notice to the informant wife. It is further directed that in the event, the learned court below finds settlement having taken place between the parties, to direct release of the petitioners on bail upon furnishing bail a bond of Rs.20,000/-(rupees twenty thousand) each with one solvent surety for the like amount each with such other conditions imposed. 6. Issue urgent certified copy of this order as per rules. (R.K. Pattanaik) Judge TUDU Designation: Sr. Stenographer
