They came inside and demanded cash, threatening to kill them. One boy out of them, put his hand into pocket of his pant and took Rs.56,000/-. Thereafter, all four of them went away. While leaving one of them picked up a fired empty shell lying outside the salesman room. Legal action was prayed for.

Learned counsel for the petitioner submits petitioner was not named in the FIR nor was present at the spot. He was implicated on the basis of alleged disclosure statement of co-accused Ajit @ Kalu. As per contents of the FIR, all persons were in muffled faces. No test identification parade of the accused was conducted by the investigating agency. Petitioner was behind bars for the last 1 year and 6 months. Out of 17, only 4 witnesses were examined. Main witnesses were yet to be examined. In the two cases registered against the petitioner, he was on bail. Considering the period of incarceration, petitioner deserves to be enlarged on bail.

Learned State counsel has filed status report in the form of affidavit of Bharat Bhushan, HPS Deputy Superintendent of Police, HQ Narnaul, District Mahendergarh and has opposed the prayer for regular bail on the ground that petitioner was the main accused, who committed robbery in the petrol pump with co-accused. One country made pistol and Rs. 4500/- were recovered from his possession. The police had collected CCTV footage of the incident, besides there was statement of owner of the petrol pump. 3 CRM-M-15151 of 2026(O&M) bail, petitioner was likely to tamper with evidence. Therefore, he did not deserve the concession of bail.

Petitioner is alleged to have committed robbery in a petrol pump and taken away Rs. 56,000/- from an employee, using a country made pistol, which is stated to have been recovered from his possession. Even though petitioner is in custody for the last 1 year and 6 months, trial is at initial stage. Only 4 witnesses have been examined out of 17. Statement of complainant is yet to be examined. Given the nature of offence and antecedents of petitioner, who is involved in two other cases, there is a strong possibility of petitioner tampering with evidence and influencing the complainant, who is yet to be examined. In view of grave and serious nature of allegations and all relevant facts and circumstances of the case, petition is dismissed. All the pending miscellaneous applications, if any, stand
